The Financial Stability Oversight Council (“Council“) published an advance notice of proposed rulemaking (“ANPR”) on October 6, 2010 that seeks public input on the criteria the Council would use to designate certain nonbank financial companies as systemically important and require them to be subject to supervision and regulation by the Federal Reserve Board (“Fed”). Comments are requested by November 5, 2010.
