The Netherlands –European Court Asked to Rule on Border Workers and 30% Ruling

KPMG Meijburg & Co. in the Netherlands reports that the country’s Supreme Court (the Hoge Raad) has asserted that it cannot rule out the possibility that the 150-kilometer (from a Dutch border) aspect of the 30% ruling represents a justifiable discrimination, i.e., a different treatment of/in similar cases, in terms of EU law. The Supreme Court has, therefore, decided to request that the European Court of Justice render its opinion on the matter.
