United States – Impact on Immigration Rules of Court’s Same-Sex Marriage Decision 

In response to a recent Supreme Court decision allowing state-sanctioned same-sex marriage to be recognized by the federal government, the United States Citizenship and Immigration Services (USCIS) has announced that it will consider green card applications for permanent resident status (green cards) for same-sex spouses of U.S. citizens without delay. This may impact global mobility concerns around inbound same-sex married couples. Where in the past it was not possible to obtain a spousal visa for an employee on assignment to the U.S., it appears that henceforward such visas should now be available.
