The ATO released for consultation a draft legislative instrument that would eliminate withholding on certain payments made to U.S. entertainers.

The Australian Taxation Office (ATO) on 10 May 2024 released for consultation a draft legislative instrument—Taxation Administration (Withholding Variation for Certain Payments to US Resident Entertainers Including Athletes) Legislative Instrument 2024 (LI 2024/D7)—that would eliminate withholding on certain payments made to entertainers who are U.S. residents.

The draft instrument would replace the instrument “Taxation Administration Act 1953—Pay as you go withholding—Variation to remove the requirement to withhold from payments for certain U.S. resident entertainers and sport persons.”

The consultation closes 6 June 2024.
