Ukraine - New transfer pricing rules effective 1 September 2013  

July 10: The parliament of Ukraine on 4 July 2013 passed tax legislation that amends the transfer pricing rules and that includes requirements for transfer pricing documentation reports.

The following transfer pricing measures will be effective 1 September 2013 (and not in 2014, as was previously expected):


  • Repeal of a provision that permits a 20% deviation from the market price
  • Limitation of the list of domestic controlled transactions
  • New measures introducing special transfer pricing audits
  • New requirements for taxpayers to prepare and file annual reports concerning controlled transactions (to be filed by 1 May of the year following the tax year)
  • Requirement for large taxpayers to submit their transfer pricing documentation reports within two months of a request for the report from the tax authorities, and for all other taxpayers to submit their transfer pricing documentation reports within one month of a request
  • New penalty provisions for non-compliance
