U.S. Court of International Trade: Slip opinions for September 3-7

  • Lifestyle Enter., Inc. v. United States [PDF 81 KB], Slip Op. 12-116 (CIT September 7, 2012): In a case concerning wood bedroom furniture from China, the court (1) sustained the Commerce Department's remand results with regard to the selection of the volume-based data to value wood inputs, and (2) remanded Commerce's decision to grant plaintiff an adverse facts available rate.
  • Telebrands Corp. v. United States [PDF 30 KB], Slip Op. 12-115 (CIT September 6, 2012): Concerning the classification for tariff purposes of certain pedicure items, the court concluded that the appropriate classification of the items is under HTSUS subheading 8214.90.90 (instead of subheading 8214.20.30).
  • Globe Metallurgical Inc. v. United States [PDF 31 KB], Slip Op. 12-114 (CIT September 5, 2012): In a consolidated action involving an administrative review conducted by the Commerce Department of the antidumping duty order covering silicon metal from China, the court sustained Commerce's remand results concerning the treatment of a surrogate financial statement used to calculate the selling, general, and administrative expenses for the margin calculation.
