February 22: The U.S. Court of International Trade posted and / or released the following opinions for the period February 18-22, 2013.

  • Dependable Packaging Solutions, Inc. v. United States, Slip Op. 13-23 (CIT February 20, 2013): Concerning HTSUS classification of glass vases imported from China, the court granted the government’s motion for summary judgment.

  • Clearon Corp. v. United States, Slip Op. 13-22 (CIT February 20, 2013): Commerce presented its remand determination concerning the second administrative review of the antidumping duty order on chlorinated isocyanurates from China. In its remand results, Commerce provided further explanation of its selection of surrogate data to value the factors of production. The court affirmed Commerce’s' remand determination. The following confidential opinion was publicly released:


  • Gold East Paper (Jiangsu) Co. v. United States, Slip Op. 12-160 (CIT December 21, 2012; released February 20, 2013): Concerning imports of coated paper from China and Indonesia, the court denied plaintiffs’ motion for judgment on the agency record, and sustained ITC’s threat-of-material-injury determination.
