  • R.T. Foods, Inc. v. United States, Slip Op. 12-152 (December 14, 2012): Concerning the correct tariff classification of the subject merchandise—frozen tempura- battered vegetable mixtures from Thailand (with a duty rate of 11.2%, instead of 0%)—the court denied plaintiff’s motion for summary judgment and granted Custom's cross- motion for summary judgment.

  • Papierfabrik August Koehler AG v. United States, Slip Op. 12-151 (December 10, 2012): The plaintiff's challenge Commerce’s use of the zeroing methodology final determination of an antidumping duty order on lightweight thermal paper from Germany. The court ordered a stay until 30 days after the final resolution of all appellate review proceedings in Union Steel v. United States (pending a decision by the Federal Circuit).
