KPMG reports: Colorado (downloaded software); New Jersey (nexus); Oregon (electricity sales); Tennessee (electronic access)

  • Colorado: A Colorado appeals court held that purchases of downloaded software and access to online databases are subject to City of Boulder use tax.
  • New Jersey: The New Jersey Division of Taxation announced a voluntary disclosure initiative for taxpayers that have not filed corporate business tax returns, but have been deriving income from the use of intangible assets within the state.
  • Oregon: The Oregon tax court held: (1) that the sale of electricity was the sale of a service, not of tangible personal property; and (2) that the sale of natural gas was a sale of tangible personal property, that the ultimate destination test applied, and that the receipts at issue were not to be included in the Oregon sales factor numerator.
  • Tennessee: The Tennessee Commissioner of Revenue issued a revenue ruling concerning electronic access to written materials and computer simulation programs provided by the taxpayer via the internet, finding that: (1) for years prior to 2009, the taxpayer’s charges for electronic access were not subject to sales and use tax; and (2) for tax periods beginning after 2009, the taxpayer’s service was taxable because, due to a law change, it was considered to be a sale of access to digital books.
