  • Del Monte Corp. v. United States, Slip Op. 12-131 (CIT October 12, 2012): Court grants summary judgment for the government in this proceeding concerning the classification and valuation of “pouched” tunafish products (i.e., fillets or strips of tunafish that was packed in microwavable pouches, to which flavorant media or sauces were added prior to export to the United States).

  • Zhaoqing New Zhongya Aluminum Co. v. United States, Slip Op. 12-130 (CIT October 11, 2012): Confirming Commerce's antidumping investigation of extruded aluminum from China, and Commerce's decision to collapse into a single entity, three affiliated exporters / producers, and to apply adverse facts available to this collapsed entity in calculating antidumping duty rates.

  • Celta Agencies, Inc. v. United States, Slip Op. 12-128 (CIT October 9, 2012): In an action challenging the liquidation instructions issued to CBP by Commerce following an administrative review of an antidumping duty order on steel concrete reinforcing bars (re-bar) from Latvia, the court granted government’s motion to dismiss, concluding that it lacks jurisdiction to hear the action and that the action is untimely according to the two-year statute of limitations. The importer had claimed that the liquidation instructions directed CBP to assess duties on the entry at the “all other” duty rate, rather than the lower, company-specific rate assigned by Commerce in its review of the Latvian producer.
