U.S. Court of International Trade: Slip opinion for September 10-14

  • Yama Ribbons and Bows Co. Ltd. v. United States, Slip Op. 12-117 (CIT September 14, 2012): The plaintiff contested Commerce’s determination of a final countervailing duty rate, and asserted that Commerce’s use of an intra-company transfer price—instead of the sales price to a U.S. company—as the denominator for the subsidy rate calculation was in error. The court rejected the plaintiff’s claim and instead found that using only the sales figures from the Hong Kong entity would be inappropriate because the related Chinese company received government subsidies.
