The recent FCE Bank Court of Appeal judgment on group relief has important implications for EU law based claims. The EU is pushing ahead with plans for a financial transaction tax with the ‘enhanced cooperation’ procedure allowing implementation in a limited number of Member States looking more likely. There have been recent legislative developments in a number of European countries including France and Germany with potentially significant implications for groups with operations in those countries.
