Vietnam - APA regime is approved, effective July 2013 

November 21: Vietnam’s National Assembly on 20 November 2012 passed legislation that introduces an advance pricing agreement (APA) regime.

Vietnam’s APA regime would allow for unilateral, bilateral, or multilateral APAs. The Vietnamese tax authority would apply an APA with taxpayers and/or foreign tax authorities located in a country with which Vietnam has an income tax treaty (a treaty for the avoidance of double taxation and to prevent income tax evasion). Currently, Vietnam’s treaty network includes over 60 countries.


This APA legislation would be effective beginning 1 July 2013. The official law has yet to be announced under the prescribed formal legislative rules.
