Ukraine - Registrations for IT companies, VAT; dispute resolution issues  

March 1: In Ukraine, there are new registration processes concerning:
  • IT companies that are subject to a special tax regime
  • Output and input value added tax (VAT) invoices

Top 10 tax dispute issues in 2012

The KPMG member firm in Ukraine has identified the following as the top 10 tax dispute issues resolved in 2012:

  • Carryforward of tax losses
  • Absence of consignment waybills does not trigger nullification of the supply agreement
  • Nullification of agreements under claims of the tax authorities
  • Burden of proof in claiming agreements invalid is shifted to the tax authorities
  • Concerning prosecutions of taxpayers for late payments, when bank was at fault
  • Taxpayers may assert decisions of the central controlling tax authority in court
  • Taxpayers not obliged to verify the status of business partners
  • Misapplication of law on the status of credit unions
  • Treatment of agricultural producers under special tax regime
  • Sale of goods below cost does not deprive taxpayer from enjoying tax credit from prior periods
