Ukraine - Increased civil penalties for illegal transfers of goods, and other customs-related developments  

February 3:   Among recent customs actions in Ukraine are the following developments:
  • Increased civil penalties apply for the illegal transfer of goods equal to 100% (200% in certain instances) of the value of the goods plus confiscation, concurrent with decriminalization for smuggling goods, effective 17 January 2012.
  • Concerning the taxation of products of processing of goods exported from Ukraine for repair, with overdue terms of reverse importation, value added tax (VAT) and excise duty liability are not triggered (State Customs Service letter № 11.1/2-12.2/17605-ЕП (30 December 2011)).
  • The Verkhovna Rada of Ukraine enacted Law № 4234-VІ amending customs duties imposed on certain second-hand goods, live cattle and raw leather, oleaginous cultures, scrap ferrous metals and wastes, scrap alloyed ferrous metals, scrap non-ferrous metals, and semi-finished goods containing such metals.
