Ukraine - New customs code is approved  

November 16: Earlier this month, at the second reading, the parliament of Ukraine (Verkhovna Rada) adopted a new customs code.

The new measures are intend to bring the customs law of Ukraine into line with certain international standards, including the International Convention on the Simplification and Harmonization of Customs Procedures and Customs Convention on Temporary Importation, as well as the World Customs Organization (WCO) Framework of Standards.


It was noted that under the former customs code, there were no direct application provisions (that is, the customs code was cross-referenced to other regulations). The new customs code includes few such cross-references. In addition, the new customs code introduces certain innovations, such as:


  • An exhaustive list of documents required for customs clearance
  • An electronic declaration option
  • An opportunity to amend customs bills upon completion of customs clearance procedures
  • Time limits for customs clearance procedures (e.g., no more than four business hours)
  • Provisions for declarations of goods at any customs office
  • The customs official’s authority to conduct customs check upon completion of customs clearance procedures (i.e., post-audit control)

Trade & customs professionals observe that the adoption of the new customs code represents an advance in addressing long-standing issues in Ukrainian customs regulations. Importers and exporters need to note that the new law is complicated, and prudent entities will consider an in-depth study of all provisions to allow for the smooth transfer of goods across the customs border.
