Spain - Energy tax proposals in pending bill 

November 9: The Spanish Cabinet in September 2012 approved a draft bill on environmental measures and energy sustainability—a bill containing tax provisions relating to energy generation and fuels—and sent the proposals on to the Spanish Parliament for its consideration.

Among the legislative proposals are tax measures that would affect electricity generation and energy consumption. Specifically, the bill would introduce new taxes including:


  • A tax on the production value of electric energy
  • A tax on the production of nuclear fuel, and with respect to radioactive waste resulting from such production and storage of spent nuclear fuel
  • A fee on the use of surface water to produce electric energy

The bill would also modify excise tax measures relating to the tax on hydrocarbons and coal taxes—e.g., with respect to resources used to produce electricity and new excise tax rates for natural gas, diesel and fuel oil, and coal.


During the legislative process, the Parliament has made changes to the bill’s provisions. Final passage is pending, but it is expected that once finalized, the legislation could have an effective date of 1 January 2013.
