Romania - VAT and excise tax changes 

May 12:  Changes to Romanian tax law, earlier this year, include revisions concerning the following value added tax (VAT) provisions:
  • Place-of-supply rules with respect to the provision of telecommunications, broadcasting services, e-services (i.e., changes to comply with EU law)
  • VAT reimbursement procedures
  • VAT refunds for entities established outside Romania and not registered or required to register for VAT purposes in Romania
  • Cancellation of VAT registrations
  • Election to apply a VAT cash accounting system
  • VAT with respect to supplies of electricity

Other changes affecting excise taxes / customs duty include:

  • Authorization of economic operators
  • Refunds of excise tax on luxury goods
  • Repeal of excise tax on beer
  • Clarifications relating to raw materials used in production / fiscal warehouses

The changes were made pursuant to Decision no. 77/2014 which was published in the official journal in February 2014. Certain provisions were effective for the date of publication, whereas other provisions were effective beginning 1 April 2014.
