EU - Excise tax on mineral oils for alumina production 

December 10: The Court of Justice of the European Union (CJEU) today issued a judgment that, for a second time, set aside a judgment of the EU General Court that had annulled a decision of the European Commission finding exemptions from excise tax on mineral oils used as fuel for alumina production granted by France, Ireland, and Italy to be in breach of EU state aid rules.

The case has been referred the case back to the General Court.


According to an EC release [PDF 58 KB], the CJEU judgment confirms the EC’s exclusive competence regarding state aid control in the EU.
