Colombia - Changes to customs law, textile tariff provisions 

February 4: A new customs law in Colombia was enacted in early January 2013, and revises the framework (general rules) for amendments to customs tariffs, rates, and other customs-related provisions.

A new decree provides rules concerning the tariffs on imports of clothing and textiles.

New customs framework law

The new customs framework law (Ley 1609 de 2013, 2 January 2013) repeals prior law (Ley 6ª de 1971), and includes new provisions that, among other items:


  • Provide that changes to the customs rules must have as an objective compliance as well as aim to facilitate the development and implementation of free trade agreements, to protect domestic production, and to explore trade options
  • Unify the customs procedural rules
  • Implement measures to prevent illegal activities, such as smuggling and money laundering

Tariff regulations for imports of clothing, textiles

A decree (Decreto 0074) (23 January 2013) was issued to modify customs tariff provisions, and provides:


  • New tariff values and new value added tax (VAT) rules for imports of certain clothing and textile goods, as well as goods including shoes, hats, umbrellas and other items classified under specific articles of the tariff code
  • Exceptions from the new tariff rules for these products if originating in countries that have a commercial agreements with Colombia
  • Exemption from the new tariff values depending on when the goods enter Colombia and depending on compliance with certain customs procedures

The decree will be effective for one year, starting on 1 March 2013.
