Argentina - Tax information exchange agreement with Cayman Islands

September 18:  A law implementing a tax information exchange agreement between Argentina and the Cayman Islands was published in Argentina’s official gazette on 12 September 2012.

The agreement (signed October 2011 [PDF 118 KB]) generally provides that the signatory countries will provide assistance through the exchange of tax information that is relevant to the administration and enforcement of either country’s domestic laws.

The tax information exchange agreement applies with respect to:

  • Information held by banks, other financial institutions, and any person, including nominees and trustees, acting in an agency or fiduciary capacity
  • Information regarding the beneficial ownership of companies, partnerships, foundations and other persons; and information on shares, units, and other interests
  • Concerning trusts, information on settlors, trustees, and beneficiaries, among others.

With respect to the Cayman Islands, the agreement will apply to any tax imposed that is substantially similar to existing taxes of Argentina to which this agreement applies.

With respect to Argentina, the agreement applies for income tax, value added tax, wealth tax, and minimum presumed income tax.
