If your company pays or receives cross-border guarantee fees or undertakes other transactions with companies in your corporate group, the recent decision of the Tax Court of Canada (TCC) in the GE Capital case will be welcome news. Ruling in the taxpayer's favour, the TCC vacated the CRA's assessments that denied the tax payer about $136 million in deductions for guarantee fees.
