This Migration Newsflash includes further details of the proposed 457 visa program changes, together with key features of the Migration Amendment (Reform to Employer Sanctions) Bill 2012 which has now been passed by the Senate. The Bill is now awaiting Royal Assent before it will take effect.
- The proposed changes to the 457 visa program will only affect applications lodged on or after 1 July 2013.
- It has been confirmed that DIAC will not be reintroducing traditional labour market testing for nominated positions as it may bring them in breach of international trade obligations.
- We are still awaiting proposed legislation to see greater detail as to how these proposed changes will impact employers and visa applicants.
