Migration Newsflash: Update on 457 visa program changes 

The Department of Immigration & Citizenship (‘DIAC’) has released further details of the 457 visa program changes announced on 23 February 2013 by Minister for Immigration, Brendan O’Connor. It has now been confirmed that the recently announced changes are expected to take effect on 1 July 2013.

This Migration Newsflash includes further details of the proposed 457 visa program changes, together with key features of the Migration Amendment (Reform to Employer Sanctions) Bill 2012 which has now been passed by the Senate. The Bill is now awaiting Royal Assent before it will take effect.

  • The proposed changes to the 457 visa program will only affect applications lodged on or after 1 July 2013.
  • It has been confirmed that DIAC will not be reintroducing traditional labour market testing for nominated positions as it may bring them in breach of international trade obligations.
